3. For what purposes do we process your data and on what legal basis?
We process personal data about you for the purpose of your application for an employment relationship, insofar as this is necessary for the decision on establishing an employment relationship with us. The legal basis for this is Section 26 (1) BDSG. Furthermore, we may process personal data about you insofar as this is necessary to defend against asserted legal claims arising from the application process against us. The legal basis for this is Art. 6 (1) (f) GDPR; the legitimate interest is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).
Insofar as we would like to store your personal data to consider you for future suitable positions, we will obtain your consent for this in accordance with Art. 6 (1) (a) GDPR.
Insofar as an employment relationship between you and us comes into existence, we may, in accordance with Section 26 (1) BDSG, further process the personal data already received from you for the purposes of the employment relationship if this is necessary for the performance or termination of the employment relationship or for the exercise or fulfillment of the rights and obligations of the employee representation resulting from a law or a collective agreement, a works or service agreement (collective agreement).
4. To whom will your data be disclosed?
We may transmit your personal data to affiliated companies, insofar as this is permissible within the scope of the purposes and legal bases set out in Section 3. In other respects, personal data is processed on our behalf on the basis of contracts in accordance with Art. 28 GDPR, this in particular by host providers or providers of applicant management systems.
5. Will your data be transferred to countries outside the European Union (so-called third countries)?
Your personal data will not be transferred to countries outside the European Union.
6. How long will my data be stored?
We store your personal data for as long as is necessary for the decision regarding your application. Insofar as an employment relationship between you and us does not come into existence, we may continue to store data insofar as this is necessary to defend against possible legal claims. In this case, the application documents will be deleted six months after the rejection decision has been communicated, unless longer storage is required due to legal disputes. If the storage is based on your consent, we will store your personal data until you revoke your consent.
7. What rights do you have in connection with the processing of my data?
You have a right to information, rectification, erasure, restriction of processing. The restrictions under Sections 34 and 35 BDSG apply to the right to information and the right to erasure. In addition, there is a right to lodge a complaint with the competent data protection supervisory authority.
Insofar as processing is carried out on the basis of a legitimate interest, you have the right to object to the processing on grounds relating to your particular situation. In the event of your objection, we will no longer process your personal data, unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defense of legal claims.
Insofar as processing is based on your consent, you have the right to revoke this with effect for the future.
To exercise your rights, please contact us or our data protection officer.
8. Is there an obligation to provide your personal data?
The provision of personal data is neither legally nor contractually required, nor are you obliged to provide personal data. However, the provision of personal data is necessary for concluding an employment contract with us. This means that if you do not provide us with personal data when applying, we will not enter into an employment relationship with you.
9. Changes to this information
Should the purpose or the manner of processing your personal data change significantly, we will update this information in good time and inform you promptly about the changes.
