DATA PRIVACY FOR APPLICANTS

Diligence and transparency are the basis for a trusting cooperation. Therefore, we inform you about how we process your personal data in the context of an application and how you can exercise your rights, which you are entitled to under the General Data Protection Regulation (GDPR) and the new Federal Data Protection Act (FDPA).

3. For what purposes do we process your data and on which legal basis?

We process personal information about you for the purpose of your application for employment, to the extent necessary for taking the decision to establish employment with us. Legal basis is § 26 para. 1 FDPA. Furthermore, we may process personal data about you, as far as this is required to defend against asserted legal claims against us arising from the application process. The legal basis is Art. 6 para. 1 (f) of the GDPR, for example, the legitimate interest is a burden of proof in proceedings under the General Equal Treatment Act (GETA).

As far as we would like to store your personal data in order to consider you for future situation suitable for you, we would get your consent according to Art. 6 para. 1 (a) GDPR.

Insofar as an employment relationship arises between you and us, pursuant to § 26 para. 1 FDPA we may further process the personal data already obtained from you for employment purposes if this is necessary for the performance or termination of the employment relationship or for the exercise or fulfillment of rights and obligations of the representation of the interests of the employee arising from legislation or wage agreement, or an operating or service agreement (collective agreement).

 

4. With whom are your data shared?

We may transfer your personal data to companies affiliated with us, insofar as this is possible within the scope of the purposes and legal provisions of para. 3. Incidentally, personal data are processed on our behalf in particular by host providers or providers of applicant management systems on the basis of contracts pursuant to Art. 28 GDPR.

 

5. Are your data transmitted to countries outside the European Union (so-called third countries)?

Your personal data will not be transmitted to countries outside the European Union.

 

6. How long will my data be stored?

We store your personal information as long as this is necessary to decide on your application. Insofar as an employment relationship between you and us does not materialise, we may also continue to store data as far as necessary to defend against possible legal claims. The application documents will be deleted six months after notification of the rejection decision, unless a longer storage is required due to litigation. If you have given your consent to the storage, we will store your personal data until you revoke your consent.

 

7. What rights do you have in connection with the processing of your data?

You have a right to information, correction, deletion, and restriction of processing. With regard to the right to information and the right to delete, the restrictions under §§ 34 and 35 FDPA apply. In addition, there is a right of appeal to the relevant data protection supervisory authority.

If processing takes place on the basis of a legitimate interest, you have the right to object to the processing for reasons arising from its particular situation. In the event of your opposition, we will no longer process your personal information unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing is for the purpose of enforcing, pursuing or defending legal claims.

If the processing is based on your consent, you have the right to revoke it with effect for the future.

8. Is there an obligation to provide your personal data?

The provision of personal information is neither mandated by law nor by contract, nor are you required to provide your personal information. However, the provision of personal information is required to enter into a contract of employment with us. This means that unless you provide your personal data to us with the application, we will not enter into any employment relationship with you.

 

9. Changes to this information

If the purpose or method of processing your personal data changes significantly, we will update this information in good time and inform you in good time about the changes.
